Fake doctor in rape case detained for absconding court

A man accused of sedating and raping a female patient was on Wednesday detained for 10 days pending a ruling on a request to cancel his bond.

The prosecution accused Mr James Mugo Ndicho alias Mugo wa Wairimu of jumping bail and taunting a witness on social media.

It was further alleged that his conduct was hell-bent on “perverting the cause of justice” and that he should be detained to fast-track the hearing and determination of the case.

An affidavit objecting to the lifting of an arrest warrant and a detention of the suspect pending the conclusion of the sensational case was also filed in court.

Chief magistrate Daniel Ogembo ordered that the accused be locked up till September 2 when he would decided whether or not to cancel a Sh5 million bond the court granted Mr Mugo after he denied the rape charge and multiple counts of operating an illegal clinic in Nairobi.

The accused failed to honour a court date on July 11 prompting a warrant for his arrest to be issued.

However, it was suspended after his lawyer presented his case file in a separate court.

Inspector Andolo Munga, said: “Since plea taking in 2015 the respondent (Mugo) has on numerous occasions applied for adjournment.”

The prosecution objected to a medical document Mr Mugo presented in court to explain his absence on July 11 saying it needed to be verified.
