Order on civil servants seeking elective seats unconstitutional, rules court

An order requiring civil servants seeking elective seats to resign six months to elections is unconstitutional, a Kericho court has ruled.

Kericho Labour Court judge Njagib Marete also declared section 43(5) of the Elections Act requiring mandatory resignation of public servants eyeing public office as unconstitutional.

He added that there is no matter of public interest in the law which he says is unfair.

Public officers can now only leave office upon nomination to run for public office.
Head of Public Service Joseph Kinyua had issued the order requiring civil servants seeking political seats to resign.
