5 people appear in court over death of 6 year old pupil

The principal of St Augustine’s Preparatory School in Mombasa and four others intend to challenge murder charges filed against them after a pupil was crushed to death by the school’s bus.

Ms Sara Kesi, bursar Venant Mwaliko, driver Valdi Mbadi, mechanic Abednego Fundi Mwendwa and bus conductor Charo Kazungu Charo on Wednesday said they would file a constitutional petition against the charge.

They described as "incredulous" the murder charge brought by Director of Public Prosecutions Keriako Tobiko.

Their lawyer, Gikandi Ngibuini, said Mr Tobiko had been pressured by social media and political forces to bring the charge, which attracts the death penalty.

Mr Gikandi argued that the pupil’s death was as a result of an accident, saying teachers have taken good care of the pupils for a long time.

“We have five people who on a daily basis have been taking care of the children, unfortunately an accident occurred,” Mr Ngibuini told Justice Dora Chepkwony.
