Ex-Senator Kivuti to move appeal against Wambora to new court

Former Embu Senator Lenny Kivuti has withdrawn a constitutional petition he had lodged in court, seeking to stop the gazettement and eventual swearing-in of Mr Martin Wambora as governor.
Mr Kivuti indicated that he would be moving to the election petition court to contest Mr Wambora’s win, claiming he was denied victory.
Mr Wambora, who was the Jubilee Party’s candidate, was declared winner after garnering 97,760 votes against Mr Kivuti’s 96,775.
IEBC TALLY
Mr Kivuti argues that he had actually beaten Mr Wambora by 487 votes but the Independent Electoral and Boundaries Commission ignored the right tally.
Mr Kivuti had also argued that the ballot materials were not safe with IEBC, claiming that some had already been tampered with.
He accuses local IEBC officials of conspiring with Mr Wambora to deny him victory and then failing to supply him with Forms 37A and 37B, which detailed the tally.
The application was filed by lawyer Daniel Kamunda.
