Joho suffers blow as court lifts ban on new tuk tuks

Mombasa Governor Hassan Joho Thursday suffered a blow after the High Court lifted a ban on the registration of new tuk tuks his administration issued five months ago.

High Court Judge Dorah Chepkwony lifted the ban after a human rights group contested the move, claiming it had rendered many youths jobless.

Justice Chepkwony further directed Commission for Human Rights and Justice (CFHRJ), the group that had sued the governor, to file the main application and serve it on the respondents, who are the clerk and county government.

Lifting the ban paves the way for registration of new tuk tuks pending  the determination of the suit.

The human rights group, under a certificate of urgency, wanted an order staying Mr Joho’s directive, arguing that it has adversely affected commuters and tuk tuk operators in the county.

In a sworn affidavit, CFHRJ executive director Julius Ogogoh argued that banning registration of new tuk tuks was wrong and ill-advised as it does not fall within the law.

The group argued that tuk tuk operators were never given an opportunity to be heard before the decision was arrived at.
